Reducing the bureaucratic burden on businesses: simplifying the licensing procedure
The new licensing rules are expected to bring less red tape, more digital services and clearer rules to businesses. Initiated by the Ministry of the Economy and Innovation (EIMIN), the Government has adopted new rules for drafting licensing legislation to help eliminate excessive requirements, simplify procedures and enable licences to be obtained more quickly via electronic channels.
'Reducing the administrative burden on businesses is one of the priorities of Lithuania’s “3i” economic transformation plan. Through this plan, we aim to reduce the administrative burden on businesses by 35 per cent and double the speed of service delivery. The changes to the licensing regime are therefore another step towards more convenient services. With these amendments, we will swiftly eliminate unjustified and excessive licensing requirements relating to 700 different licences and simplify these procedures,' says Darius Zailskas, Vice Minister for the Economy and Innovation.
The amendments focus on simplifying licence issuance procedures. Licensing authorities must ensure that applications and documents can be submitted electronically via a 'one-stop shop' system, such as the e-Government Gateway portal or another accessible information system. If the data required to issue a licence is already available in state or local authority information systems, the licensing authority itself must retrieve it rather than requiring the applicant to provide it.
Furthermore, when adopting any new amendments to the licensing regime, justification must be provided for each new requirement to obtain a licence. Before establishing or amending a licensing regime, the relevant authorities must assess the problem being addressed, the public interest to be protected, and the necessity and proportionality of the licensing. They must also consider possible less restrictive alternatives and ensure that the regime does not discriminate.
General requirements have also been set out for submitting licence data to the Licence Information System and for ensuring the traceability of licence-related actions. These measures will enable more consistent management of information regarding the issuance, amendment, suspension or revocation of licences and ensure that the basis for decisions can be identified.
